Notice Of Public Interest Adopting the Warranty Regulations

The Department of Consumer Affairs (DACO, or the Department), is in the process of adopting the WARRANTY REGULATIONS. This Regulation is promulgated according to the powers conferred to DACO by virtue of Laws No. 228 of May 12, 1942, No. 5 of April 23^rd, 1973, No. 7 of September 23^rd, 1979, No. 402 – 2000, and No. 38 – 2017, as amended; and Law No, 107-2019.

As promulgated by this Department, the purpose of the WARRANTY REGULATIONS is to achieve adequate protection for consumers and their investments in vehicles, assistive technologies devices, and power generators. Our main objective is that any product in these categories, acquired in Puerto Rico, serves the purpose for which it was acquired, and meets the minimal conditions to ensure a use that is both safe and satisfactory.

The WARRANTY REGULATIONS supersedes and, consequently, repeals the following Regulations: 1) No. 7159, Vehicles Regulations, 2) No. 7920, Vehicles Regulations Amendment, and 3) No.  8567, Regulations for Assistive Technologies Devices. It also includes new rules, which apply to power generators, in comply with mandatory Law No. 107-2019.

Prior to the filing of the aforementioned regulation with the State Department, DACO will be evaluating the comments and suggestions submitted to us by both consumers and merchants until February 25^th, 2020, to the following email: secretaria@daco.pr .gov. The Department will also hold oral hearings on February 25^th, 2020, at Centro Gubernamental Minillas Torre Norte, Piso P, Salón A.

We request that those who wish to express their positions during the oral hearings inform us before these proceedings, in order to be properly scheduled. We also request to submit previously your presentations to the email secretaria@daco.pr.gov.
