AVISO DE INTERÉS PÚBLICO PROCESO DE ADOPCIÓN DEL REGLAMENTO SOBRE REQUISITOS DE ORIENTACIÓN AL CONSUMIDOR PARA LA VENTA DE NEVERAS PORTÁTILES DE POLIESTIRENO

AVISO DE INTERÉS PÚBLICO

EL REGLAMENTO SOBRE REQUISITOS DE ORIENTACIÓN AL CONSUMIDOR PARA LA VENTA DE NEVERAS PORTÁTILES DE POLIESTIRENO promulgado por el DACO tiene el propósito de actuar conforme al mandato legislativo que le delegó el deber orientar, regular y fiscalizar ciertos aspectos relacionados a la prohibición en el uso de neveras portátiles de poliestireno o foam en los balnearios, cuerpos de agua y playas de Puerto Rico.

Previo a su radicación en el Departamento de Estado, el DACO estará analizando los comentarios y sugerencias que se sometan hasta el 17 de octubre de 2021, al correo electrónico: reglamentoneveras@daco.pr.gov.  El Departamento también celebrará vistas orales, las cuales se llevarán a cabo el 13 de octubre de 2021, de 9:00 a.m. – 12:00 p.m., a través de la plataforma TEAMS. El enlace para participar se enviará el día previo a la actividad a todas aquellas personas que notifiquen su interés en ser parte del proceso con, al menos, dos días de antelación al correo electrónico reglamentoneveras@daco.pr.gov.

El REGLAMENTO SOBRE REQUISITOS DE ORIENTACIÓN AL CONSUMIDOR PARA LA VENTA DE NEVERAS PORTÁTILES DE POLIESTIRENO está disponible para revisión en la Página Web del DACO, www.daco.pr.gov.

NOTICE OF PUBLIC INTEREST

The Department of Consumer Affairs (DACO, or the Department), has begun the process of adopting the REGULATION ON CONSUMER GUIDANCE REQUIREMENTS FOR THE SALE OF PORTABLE POLYSTYRENE REFRIGERATORS. This Regulation is promulgated according to the delegated powers conferred to DACO by virtue of Laws No. 5 of April 23^rd, 1973; and No. 16 – 2021.

The purpose of the REGULATION ON CONSUMER GUIDANCE REQUIREMENTS FOR THE SALE OF PORTABLE POLYSTYRENE REFRIGERATORS as stated per the legislative mandate included in the aforementioned statutes is to guide, regulate and oversee specific attributes in the forbiddance of use of portable polystyrene refrigerators also known as foam refrigerators at balnearios, water bodies and beaches in Puerto Rico.

Prior to the final adoption and submission to the Department of State, DACO will analyze until the 17^th October all comments and suggestions the public may have on the REGULATION ON CONSUMER GUIDANCE REQUIREMENTS FOR THE SALE OF PORTABLE POLYSTYRENE REFRIGERATORS and that are been received to the following email: reglamentoneveras@daco.pr.gov. The Department will also hold a public oral hearing on Wednesday, October 13^th of 2021 by the online platform Microsoft TEAMS. The link will be available the day before the hearing to all persons that previously expressed their intention to participate. Any person interested in expressing their opinions during the oral hearings should notify us at least two days in advance of the hearing to the email reglamentoneveras@daco.pr.gov.

Este anuncio es requerido por la Sección 2.1 de la Ley 38 – 2017, la cual dispone que “[s]iempre que la agencia pretenda adoptar, enmendar o derogar una regla o reglamento, publicará un aviso en español y en inglés en no menos de un periódico de circulación general en Puerto Rico, y en español e inglés en la red de internet”.
